These Terms of Service govern your use of the memver website, beta waitlist, Apple TestFlight beta, and memver beta app.
By using memver, joining the beta waitlist, or participating in the TestFlight beta, you agree to these Terms and our Privacy Policy. If you do not agree, do not use memver.
1. What memver is
memver is a personal gallery AI that helps you organize your photo library, search your memories, and learn from information you confirm.
memver is not a photo backup service, cloud photo storage service, legal evidence archive, professional advisory service, medical service, legal service, financial service, or emergency service.
2. Beta service
memver may be provided as a beta service.
Beta services are experimental and may be incomplete, unstable, or changed at any time. Features may be added, removed, limited, paused, or discontinued.
memver does not guarantee that the beta service will be uninterrupted, error-free, available on all devices, or accurate in all cases.
3. TestFlight
The memver beta may be distributed through an Apple TestFlight public link.
If you install or use memver through TestFlight, Apple's TestFlight Terms and related Apple policies also apply.
Apple may control TestFlight availability, build expiration, supported devices, feedback, installation, and other TestFlight-specific behavior.
memver is not responsible for Apple TestFlight service issues, Apple account issues, installation issues, or Apple policy changes outside memver's control.
4. Eligibility
memver is intended for users who are at least 14 years old.
If you are under the age of majority in your jurisdiction, you should use memver only with consent from your parent or legal guardian.
You must have the legal right to use the service in your country or region.
5. Beta waitlist and email
You may join the memver beta waitlist by providing your email address.
You must not submit someone else's email address without permission.
memver may use your email to send beta access information, TestFlight public links, and product updates. You may opt out or request deletion by contacting privacy@memver.app.
6. Photo access and analysis
memver starts photo library analysis only after you grant photo access and explicitly start analysis in the app.
Granting photo access is not the same as starting whole-library analysis.
During the beta, memver does not upload your original photos or videos to memver servers. Photo analysis is performed on your device by default.
However, conversations, information you confirm, text or metadata generated through on-device analysis, inferred results, and text-based indexes for search and organization may be stored on our servers.
7. People and face-related data
memver treats people and face-related data as sensitive.
During the beta, face detection, people grouping, and person-related embeddings are processed on your device by default.
memver does not store the following on its servers by default:
- raw face crops
- face embeddings
- upper-body embeddings
- person exemplar dictionaries
- automatic contact-based identity matching results
memver does not automatically assign real names to people. Names are saved only when you confirm or enter them.
memver does not perform cross-user face matching or automatically infer sensitive relationships.
8. AI features and limitations
memver uses AI and automated analysis to suggest photo groups, search results, cleanup candidates, explanations, summaries, and memory cues.
AI results may be inaccurate. For example, memver may:
- group different people together incorrectly
- split the same person into different groups
- suggest the wrong place, time, or event
- misunderstand your request
- suggest a cleanup candidate that you may want to keep
AI output is for your review and convenience. You are responsible for checking results before relying on them.
memver is designed not to treat inferred information as confirmed fact until you confirm it.
9. Confirmed information
You may teach memver people, places, events, groups, notes, relationships, and descriptions.
memver may interpret your natural language input and, when needed, ask you to confirm a structured proposal before saving it.
Information you confirm may be used to improve search, organization, recall, grouping, and explanations.
You may request correction or deletion of information you confirmed.
10. No automatic deletion
memver does not automatically delete your photos.
memver may suggest duplicate photos, blurry photos, similar photos, or cleanup candidates. Actual deletion requires your explicit confirmation.
During beta, memver does not automatically write back to or modify your original photo library by default.
11. External AI providers
memver may use external AI providers for conversation understanding, search explanations, organization assistance, and summarization.
During the beta, memver does not send original photos or videos to external AI providers.
External AI providers may process:
- your questions
- conversation text
- information you confirm
- text summaries generated from photo analysis
- inferred results that do not include original photos
In the future, if you select a specific photo and explicitly allow an advanced visual explanation feature, the selected photo or a reduced preview may be sent to an external AI provider. This will be presented with separate notice and consent.
12. Your content
You keep ownership of the content you provide to memver.
You grant memver a limited, non-exclusive right to store, process, analyze, display, transform, and index your content only as needed to provide, operate, secure, debug, and improve the service.
This right is limited to service operation. It ends when the relevant content is deleted, except where retention is required for legal, security, backup, or abuse-prevention purposes.
13. Prohibited conduct
You may not:
- use someone else's email, account, photos, or personal information without permission
- violate another person's privacy, likeness rights, copyright, or reputation
- process illegal intimate images, non-consensual sensitive images, child sexual abuse material, or unlawful content
- use memver for stalking, harassment, threats, discrimination, surveillance, or privacy invasion
- misuse people or face-related features to identify, monitor, or discriminate against others
- bypass security, authentication, permissions, or usage limits
- scrape, automate, overload, or attack the service
- reverse engineer or extract source code except where legally permitted
- upload malware or exploit vulnerabilities
- violate applicable law or third-party rights
memver may suspend or terminate access if you violate these Terms.
14. Your responsibilities
You are responsible for managing your device, account, email, and permissions.
You are responsible for reviewing memver's suggestions before deleting, sharing, labeling, or relying on any result.
You must have the necessary rights or permissions before submitting or confirming information about other people.
15. Changes and availability
memver may change, suspend, limit, or discontinue all or part of the service when needed for beta testing, security, maintenance, provider outages, legal compliance, Apple policy compliance, or product development.
We will try to provide notice when practical, but urgent security or operational issues may require immediate changes.
16. Third-party services
memver may rely on third-party services such as Apple TestFlight, Vercel, email delivery providers, external AI providers, map services, and cloud database providers.
Third-party services may be governed by their own terms and privacy policies.
memver is not responsible for third-party outages, policies, account issues, or data practices outside memver's control.
17. Fees and payment
The memver beta is currently free.
We may introduce paid features, subscriptions, in-app purchases, advanced AI features, or additional storage in the future. If we do, we will provide separate pricing, renewal, cancellation, refund, and withdrawal terms before charging you.
Until paid features are introduced, these Terms do not establish paid service terms.
18. Intellectual property
memver, including its brand, logo, mascot, interface, software, documentation, design, code, and service structure, is owned by memver or its licensors.
You receive only a limited right to use the service under these Terms.
You may not copy, modify, distribute, sell, lease, reverse engineer, extract source code from, or create derivative works from memver without written permission, except where legally permitted.
19. Feedback
You may provide feedback, bug reports, suggestions, or ideas.
memver may use your feedback without compensation to improve the product, fix bugs, develop features, improve documentation, or refine messaging.
If your feedback contains personal information, it will be handled under our Privacy Policy.
20. Deletion and termination
You may stop using memver at any time.
You may request deletion of your waitlist email, account, conversations, or confirmed information by contacting privacy@memver.app.
memver will delete relevant information from active service data within 7 days of your request.
Some logs or backup data may be retained for a limited period when necessary for legal obligations, security investigations, abuse prevention, or backup recovery. Such data will not be used for ordinary service purposes.
Data processed by Apple through TestFlight is subject to Apple's policies and retention periods.
21. Disclaimers
memver is provided on an "as is" and "as available" basis during beta.
To the extent permitted by law, memver does not guarantee that:
- the service will always be available
- all AI results will be accurate
- all search results will be complete
- all cleanup suggestions will match your preferences
- all errors will be fixed immediately
- the service will work the same across all devices, OS versions, or photo libraries
- the service will produce any specific memory, organization, or storage-saving outcome
memver will make reasonable efforts to improve reliability, security, privacy, and user control.
22. Limitation of liability
To the extent permitted by law, and except in cases of intent or gross negligence, memver is not liable for:
- temporary service interruptions or beta errors
- inaccurate AI analysis
- user choices related to deletion, sharing, labeling, or confirming information
- device, network, OS, or TestFlight issues
- third-party provider outages or policy changes
- user violation of these Terms
- consequences of inaccurate information provided by the user
Nothing in these Terms limits liability that cannot be limited under applicable law.
23. Indemnity
If your violation of these Terms, unlawful use of the service, or infringement of another person's rights causes harm to memver or a third party, you may be responsible for that harm.
24. Governing law and disputes
These Terms are governed by the laws of the Republic of Korea.
If a dispute arises, you and memver will first try to resolve it through good-faith discussion.
If the dispute cannot be resolved, jurisdiction will be determined according to applicable law.
